Welcome to DabCat Ranch. These Terms of Service (“Terms”) govern your access to and use of our website, online store, and related services (the “Services”) operated by DabCat Ranch, a Tucson, Arizona business. “We,” “us,” or “our” means DabCat Ranch.
By using the Services (browsing, shopping, or purchasing), you agree to these Terms, our Privacy Policy, Shipping Policy, and Return & Refund Policy. If you don’t agree, don’t use the Services.
1. Eligibility & account
You must be at least 18 (or the age of majority where you live) to use the Services. By using them, you confirm that and you are responsible for any minors using the Services on your devices.
If you create an account or place an order, give accurate, current information. You are responsible for account security and all activity under it. Don’t share or transfer your account.
2. Products & descriptions
We work to show accurate details. Colors, textures, and appearance can vary with your screen. Small-batch items (spice mixes, soaps, and similar) can vary slightly in scent, color, or look.
We may update product information, discontinue items, or limit quantities without notice.
Spice mixes are seasonings for home cooking. They are not medical advice and not a substitute for safe food handling.
All sales are final except as described in our Return & Refund Policy.
3. Orders
Placing an order is an offer to buy. We may accept, decline, or cancel for reasons including pricing errors or stock. An order is not accepted until we confirm it and process payment. If we can’t fulfill it, we’ll email you.
Purchases are for personal or household use. Wholesale redistribution needs our written permission.
4. Prices, billing & payment
Prices are as shown at checkout and exclude taxes, shipping, duties, or fees unless stated. Prices and promotions can change without notice.
You must provide valid payment information and authorize the charges. We accept major cards through Shopify Payments. You agree to pay all charges, including tax and shipping.
5. Shipping & delivery
Typical spice orders ship FedEx Home from Tucson. Shipping is a flat $5.95, or free on orders of $35 or more, unless a listing says otherwise. Delivery dates are estimates, not guarantees.
Title and risk of loss pass when we hand the package to the carrier. We are not the carrier. Damaged, lost, missing, or wrong items are handled under the Return & Refund Policy.
6. Intellectual property
Content on the Services (text, images, logos, designs, photos) is owned by DabCat Ranch or our licensors and protected by U.S. law. Personal, non-commercial use only. No copying, modifying, or commercial use without written permission.
DabCat Ranch names, logos, and slogans are ours. Don’t use them without permission. Shopify’s marks are Shopify’s.
7. Third-party tools & links
Third-party tools (including Shopify apps) are provided “as is.” Use them at your own risk. Links to other sites are for convenience. We aren’t responsible for their content or practices.
8. Relationship with Shopify
The store is powered by Shopify. Sales are between you and DabCat Ranch. Shopify is not a party to your purchase and assumes no liability for it. You release Shopify from claims related to your transactions with us.
9. Privacy
Personal information is handled under our Privacy Policy and Shopify’s policies. Using the Services means you consent to that collection and processing.
10. Feedback
Ideas or feedback you send us may be used by us for any purpose, including commercial use, with no payment or obligation to respond.
11. Errors
We may correct typos, pricing mistakes, or omissions at any time, including after an order is placed, without liability.
12. Prohibited uses
Use the Services only for lawful purposes. Don’t violate law; infringe IP; harass; send spam or malware; impersonate anyone; or interfere with the Services. We may suspend or terminate access for violations.
13. Termination
We may terminate or suspend access at any time without notice. Terms that should survive (IP, disclaimers, liability, and similar) survive.
14. Disclaimer of warranties
Services and products are provided “as is” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We don’t guarantee uninterrupted, error-free, or secure use. The spice-mix taste guarantee is only as stated in the Return & Refund Policy.
15. Limitation of liability
To the fullest extent allowed by law, DabCat Ranch, Shopify, and our affiliates are not liable for indirect, incidental, special, consequential, or punitive damages (including lost profits or data), even if advised of the possibility.
16. Indemnification
You agree to defend, indemnify, and hold harmless DabCat Ranch, Shopify, and our affiliates from claims and losses (including reasonable attorneys’ fees) arising from your breach of these Terms, violation of law or others’ rights, or use of the Services.
17. Severability & waiver
If one provision is invalid, the rest stay in force. A waiver of one breach is not a waiver of later breaches.
18. Entire agreement & changes
These Terms plus the policies they reference are the full agreement. We may update them by posting a new version. Continued use is acceptance.
19. Governing law
Arizona law governs (without conflict-of-law rules). Disputes are resolved exclusively in state or federal courts in Pima County, Arizona. You consent to that venue.
